Nischal says 95% WazirX Users Support Us; Gave No Option 5 days ago

WazirX exchange co-founder Nischal Shetty filed a third affidavit in the Singapore High Court on September 19 in relation to a moratorium application, wherein he claimed that 95% respondents (64,043 users) of an “informal” survey supported his application; however he introduced no as an option in the survey, only five days ago.

According to the contents of 72 pages long affidavit filed by Shetty as director of Zettai, the Singapore based parent entity of WazirX platform, a total of 67,299 WazirX users participated in an informal online survey for his moratorium application. The moratorium application submitted to Singapore HC is to seek a relief of six months from any legal action against the exchange management and a subsequent user compensation process, post the Rs 2000 crore hack of WazirX on July 18.

According to Shetty, out of the 67, 299 survey respondents, 64,043 users gave their support, 2491 opposed and 765 had “no position” from August to September 17 this year. Shetty claims in the affidavit that 95% survey respondents have supported his moratorium application however, it is pertinent to note that Shetty launched this informal survey in August and initially gave only “yes” as an option to users. It was only on the orders of Singapore HC judge that WazirX management introduced “no” and “no position” options in the survey on September 12 i.e. five days before the survey results were taken by Shetty.

Moreover, there are 4.4 million active WazirX users who are awaiting their funds withdrawal. If we take their numbers into account then Nischal has managed to secure 1.4% user support till now. Additionally, Shetty also claimed that he has received support of 961 users through specific emails. In his affidavit, Nischal clearly explains his self-declared rules that those users who gave their consent to moratorium, before the no option was included in the survey, their support will be automatically added.

The third affidavit filed by Shetty comes after two months of WazirX hack on July 18 that resulted in loss of Rs 2000 crore worth of cryptocurrencies that were user funds. Since the hack, WazirX management have accused their erstwhile security partner Liminal Custody of failure to stop breach and have also blamed their estranged partner Binance for not sharing responsibility of user crypto funds. Both Binance and Liminal Custody have trashed the allegations made by Shetty and accused him of mismanagement.
